PATERNITY

​

Paternity cases help determine a child’s biological father, often through DNA testing. Establishing paternity may be important for financial support, inheritance rights, parental involvement, access to benefits, and understanding a child’s medical and genetic history.

CUSTODY AND VISITATION

​

There are two types of custody: legal custody and physical custody.

​​

  • Legal custody refers to a parent’s authority to make important decisions about a child’s health care, education, and welfare.

  • Physical custody refers to where the child lives and which parent the child spends most of their time with. Both legal and physical custody may be joint, meaning shared, or sole, meaning primarily held by one parent.



Visitation may include scheduled, reasonable, supervised, or no visitation for the non-custodial parent.

CHILD SUPPORT AND SPOUSAL SUPPORT

​

Child support is a monthly payment made by one or both parents to help cover a child’s living expenses. The amount may be calculated under California guidelines or agreed upon by the parents if no government assistance is being received. Child support is generally based on both parents’ income.

​

Spousal support is a monthly payment from one spouse to the other. It may be temporary or long-term, often depending on the length of the marriage, and is generally based on both parties’ income.

EX PARTE

​

An Ex Parte Request for Order is an expedited hearing used for urgent situations involving the health or safety of a child or parent.

MARITAL SETTLEMENT AGREEMENTS

​

A Marital Settlement Agreement outlines the parties’ agreements on the issues in their divorce. For example, the parties may agree on how to divide belongings, assets, and debts through negotiation and compromise, without needing the court to decide those matters for them.

MODIFICATIONS OF EXISTING ORDERS

​

A Request for Order may be used to ask the court to modify an existing judgment or order when circumstances have changed, including matters involving child support, spousal support, or child visitation.
